Terms of Service

These Terms of Service ("Terms") govern your use of the LinkedIn AI Enhancer mobile app and the website at linkedinaiheadshot.com (together, the "Service"), operated by Digital Apps LLC ("we", "us", "our"). By using the Service you agree to these Terms.

1. Who may use the Service

You must be at least 13 years old (16 in the EU/UK) to use the Service. You must have the legal right to upload any photo you submit.

2. Accounts

The Service does not require an account. We identify your device or browser with a random identifier generated on-device so we can deliver what you purchased.

3. Purchases and refunds

A headshot pack is a one-time purchase priced as shown at the time of purchase. There is no subscription.

• On the web, payment is processed by Stripe. If you are not satisfied, you may request a free re-generation, or a full refund on request — see our Refund Policy.
• On iOS, payment is processed by Apple as an in-app purchase. We cannot issue refunds for App Store purchases directly; request one from Apple at https://reportaproblem.apple.com. We will still re-generate your pack at no cost if you contact us.

4. License to use generated images

Subject to these Terms, we grant you a worldwide, royalty-free, non-exclusive license to use the headshots generated for you for personal and professional purposes — including LinkedIn, resumes, websites, and business cards. You may not resell the images as stock photography or sublicense them.

5. Your representations about uploaded photos

By uploading a photo you represent and warrant that:

• you are the person depicted, or you have obtained consent from every identifiable person in the photo;
• you are not uploading photos of minors;
• you are not attempting to impersonate another person, including any public figure;
• you have the legal right to upload the photo for this purpose.

You agree to indemnify us against claims arising from your violation of this section.

6. Prohibited uses

You may not use the Service to:

• create likenesses of any real person without their explicit consent;
• generate content depicting minors, sexual content, violence, or hateful content;
• deceive, defraud, or impersonate any person or entity;
• train other AI models on outputs from the Service;
• violate any law.

7. AI-generated content

Generated headshots are produced by AI models. They are not photographs and may contain artifacts, inaccuracies, or alterations to your appearance. Outputs from generative AI can be unpredictable.

8. Service provided "as is"

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT GENERATED OUTPUTS WILL BE FREE OF ARTIFACTS, ACCURATE, OR SUITABLE FOR ANY PURPOSE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) FIVE DOLLARS (US$5). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Indemnification

You agree to defend and hold us harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising out of your use of the Service or your breach of these Terms, including claims related to photos you upload.

11. Binding arbitration; class-action waiver

Any dispute arising from these Terms or your use of the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. YOU AND WE WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE ACTION. The arbitration will be held in the federal judicial district where you live; otherwise, in King County, Washington. This provision does not apply to small-claims court actions or to enforcement of intellectual-property rights.

12. Opt-out of arbitration

You may opt out of Section 11 by emailing us within 30 days of first using the Service with the subject "Arbitration Opt-Out" and your device identifier.

13. Governing law

These Terms are governed by the laws of the State of Washington, without regard to conflicts-of-law rules.

14. Changes

We may update these Terms. Continued use after a material change indicates acceptance. We will surface material changes in-app or on the website.
